1. General Terms
These Terms of Service govern access to and use of THE GRID website at the-grid.biz and the associated Discord app, provided by Nexwave systems and the THE GRID Team. By using THE GRID, whether through the website or the Discord app, you agree to these terms.
2. Definitions
For the purposes of these Terms of Service, the following definitions apply:
- "Service" refers to THE GRID website (the-grid.biz) and the associated Discord app.
- "User" refers to any person who accesses or uses the Service.
- "Content" refers to all data, text, images, messages, posts, and other information provided or exchanged through the Service.
3. User Obligations and Code of Conduct
Users are obligated to use the Service exclusively in accordance with applicable laws. It is prohibited to publish content that is illegal, offensive, discriminatory, threatening, or harmful. Using THE GRID for fraudulent or unlawful purposes is forbidden. Also prohibited are bypassing or impairing security mechanisms and unauthorized access to data or user accounts of others.
Furthermore, it is prohibited to engage in spam, unwanted advertising, or any automated behavior such as operating bots without explicit permission. Users commit to not burdening the platform with disruptive or mass messages, repeated content, or other forms of spam.
For use of the Discord app, Discord's current Terms of Service and age requirements also apply.
4. Limitation of Liability and Disclaimer
THE GRID is provided "as is". Nexwave systems and the THE GRID Team assume no warranty for uninterrupted availability, error-free operation, or completeness of the Service.
Liability for damages is excluded to the extent legally permissible. This applies in particular to indirect damages, consequential damages, lost profits, or data loss. Liability for intentional or grossly negligent breaches of duty as well as damages from injury to life, body, or health remains unaffected.
Nexwave systems and the THE GRID Team are not liable for content, actions, or omissions of users or third parties. Users are solely responsible for their content and its legality.
5. Privacy

6. Intellectual Property
All content, including but not limited to text, images, graphics, logos, designs, emojis, symbols, audio and video files provided through THE GRID (website and Discord app) are protected by copyright and/or trademark law and are the property of Nexwave systems and/or the THE GRID Team, unless otherwise stated.
The use, reproduction, modification, distribution, or public display of this content without express written consent from Nexwave systems or the THE GRID Team is not permitted.
7. Termination and Access
Nexwave systems and the THE GRID Team reserve the right to restrict, block, or terminate access to THE GRID (website and Discord app) at any time and without prior notice, particularly in case of violations of these Terms of Service or applicable law.
Users may terminate their use of the Service at any time. Upon termination, all rights of the user to the Service expire.
THE GRID may discontinue, modify, or temporarily make unavailable the Service or individual features at any time, without giving rise to any claims against Nexwave systems or the THE GRID Team.
8. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law, or special public fund, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Service is the registered office of Nexwave systems in Germany.
9. Changes to the Terms of Service
Nexwave systems and the THE GRID Team reserve the right to modify or supplement these Terms of Service at any time. Users will be informed of significant changes in a timely manner. Continued use of THE GRID after a change to the Terms of Service constitutes acceptance of the amended terms.
